1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of mrmoustachefoods.com (the "Site") and any purchase you make from Mr Moustache Foods FZE ("Mr. Moustache Foods," "we," "us," or "our"), a company registered in the SPC Free Zone, Sharjah, United Arab Emirates. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Site, you represent that you meet this requirement.

3. Products & Pricing

We sell gourmet food products, including hot sauces and condiments. We make reasonable efforts to display product information, including ingredients and allergen information, accurately, but we do not warrant that product descriptions are error-free. Prices are listed in USD unless otherwise stated and may change without notice. We reserve the right to limit quantities and to refuse or cancel any order at our discretion, including in cases of suspected fraud or pricing errors.

4. Allergens & Food Safety

Our products may be manufactured in a facility that also processes common allergens. Please review ingredient labels carefully before consumption. We are not liable for allergic reactions resulting from a failure to review product labeling.

5. Orders & Payment

When you place an order, you offer to purchase the product at the listed price. We reserve the right to accept or decline your order. Payment is processed at checkout through our third-party payment providers; you agree to provide accurate and complete payment information. The Site may contain links to, or integrate with, third-party websites or services, including payment processors. By accessing or using any third-party site through our Site, you may become subject to that third party's own terms of service and policies. It is your sole responsibility to review and comply with any such third-party terms; we are not responsible for the content, practices, security, or policies of any third-party site.

6. Shipping & Delivery

We currently ship to addresses within the United States only. Shipping timeframes are estimates only and are not guaranteed. Risk of loss and title to products pass to you upon our delivery to the shipping carrier.

7. Returns, Refunds & Cancellations

Because our products are consumable food items, we generally do not accept returns for opened or perishable products for food-safety reasons.

Order Cancellations: You may cancel your order for a full refund at any time before it has been dispatched. Once an order has been dispatched, it can no longer be cancelled or refunded except as set out below.

Damaged, Defective, or Incorrect Items: If you receive a damaged, defective, or incorrect item, contact us at hello@mrmoustachefoods.com within 7 days of delivery with photos of the issue, and we will offer a replacement or refund at our sole discretion. Claims submitted after 7 days from delivery are not eligible for a refund or replacement.

8. Marketing Communications

By providing your email address at checkout or through our sign-up form, you may receive marketing communications from us, including product updates and promotions. You can unsubscribe at any time using the link in any marketing email. This is separate from transactional emails (such as order confirmations), which you will continue to receive regardless of marketing preferences.

9. Intellectual Property

All content on the Site — including the Mr. Moustache name, logo, mascot, product photography, and text — is owned by or licensed to us and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our written permission.

10. Prohibited Conduct

You agree not to use the Site for any unlawful purpose, to interfere with the Site's operation, to attempt unauthorized access to our systems, or to submit false or fraudulent orders.

11. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law.

12. Limitation of Liability

To the maximum extent permitted by law, Mr Moustache Foods FZE shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits or revenue, arising from your use of the Site or our products, regardless of the legal theory asserted. Our total aggregate liability for any claim arising out of or relating to these Terms or your order shall not exceed the amount you paid for the product giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mr Moustache Foods FZE, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, labor disputes, carrier delays, or supply chain disruptions.

15. Governing Law

These Terms are governed by and construed in accordance with the laws and regulations of the SPC Free Zone, Sharjah, United Arab Emirates, without regard to conflict-of-law principles.

16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Site. Our failure to enforce any right or provision shall not be deemed a waiver of that right or provision.

17. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
